    The parties to this Contract agree as follows:


    A kW-DC rated roof mounted solar photovoltaic system at the property located at address listed above. This Section 3 shall only be binding and applicable if Owner is purchasing a solar photovoltaic system.

    B- By marking the checkbox below, Owner acknowledges and represents the following:

    2. If Owner’s connection to Owner’s electric company is interrupted for any purpose Owner will not have electricity in Owner’s home.

    C. SOLAR SYSTEM INSTALLATION TERMS AND COMPLIANCE

    Installations must be completed in accordance with all laws, codes and other requirements applicable under federal, state and local authority (e.g. permits, inspections). To the extent required by the law all work shall be performed by individuals duly licensed and authorized by law to perform said work.

    D. TAX CREDITS AND INCENTIVES DISCLAIMER

    We recommend the client seek the appropriate consultation concerning any tax liabilities that may be associated with the receipt of the rebate. Tax Credits are an estimated amount. As the purchaser and Client of a solar photovoltaic system, you may qualify for certain federal, state, local or other rebates, tax credits or incentives (collectively, "Incentives"). If you have any questions as to whether and when you qualify for any Incentives and the amount of such Incentives, please consult and discuss with your personal tax or financial adviser. MyState Energy and/or any separate financing partner make no representation, warranty or guarantee as to the availability or amount of such incentives.

    E. ENERGY PRODUCTION AND PERFORMANCE DISCLAIMER

    No amount of energy savings, energy production or income generation are guaranteed as a result of the purchase and installation of eligible equipment. Client acknowledges that Solar Panel System performances vary from site-to-site and season-to-season and that average production estimates are non-binding estimates based on industry standard data available for your location. Client is responsible for trimming or/maintaining trees and/or vegetation that may shade solar arrays and reduce electricity production.

    F. UTILITY REGULATIONS AND INTERCONNECTION REQUIREMENTS

    Federal, State, Local, Utility program guidelines and rebate levels are subject to change without notice and may be terminated by executive, legislative, or regulatory action at any time. Utility rates are also subject to change. EVOLUTION POWER LLC is not accountable for the loss of rebate, income, savings, or delays resulting from such a situation. Local utilities have additional requirements for solar interconnection depending on provider and system size. For example, Florida Power & Light, Duke Energy, and many utilities require the Owner to provide proof of current general liability insurance with minimum of $1 million incident coverage for any Tier 2 system (10 kilowatts AC to 100kW AC) for duration of interconnection agreement participation. Failure to complete the requirements of local utility, including fulfilling application’s requirements additional requirements, may prevent client from obtaining legal interconnection of renewable energy system, and thereby EVOLUTION POWER LLC cannot uphold any expected energy savings without interconnect completed.

    G. LIMITATION OF LIABILITY AND FORCE MAJEURE

    Contractor does not, will not, and cannot hold responsibilities in relation to any form of damage caused by wind, accumulated snow, ice or hail on or around the solar array or anyacts of force majeure.

    All agreements regarding performance of the work are stated herein. All modifications to this agreement shall be in writing and signed by Evolution Power LLC and the Customer.     According to FLORIDA’S CONSTRUCTION LIEN LAW (SECTIONS 713.001-713.37, FLORIDA STATUTES),

    1. Those who work on your property or provide materials and services and are not paid in full have a right to enforce their claim for payment against your property. This claim is known as a construction lien.
    2. If your contractor or a subcontractor fails to pay subcontractors, sub-subcontractors, or material suppliers, those people who are owed money may look to your property for payment, even if you have already paid your contractor in full.
    3. If you fail to pay your contractor, your contractor may also have a lien on your property. This means if a lien is filed, your property could be sold against your will to pay for labor, materials, or other services that your contractor or a subcontractor may have failed to pay.
    4. To protect yourself, you should stipulate in this contract that before any payment is made, your contractor is required to provide you with a written release of lien from any person or company that has provided to you a "notice to owner."
    5. Florida's construction lien law is complex, and it is recommended that you consult an attorney.

    The undersigned hereby agree to comply with all terms and conditions set forth in this Agreement. By providing an electronic signature below, the Owner confirms receipt of a full copy of this Agreement, including the material list and all attached exhibits. The electronic signature of this document shall serve as a legally binding obligation on the Parties.

    Notice of Cancellation:


    1. You may CANCEL this transaction, without any Penalty or Obligation until midnight of the third business day after the day on which you sign this Agreement.
    2. If you cancel, any property traded in, any payments made by you under the contract or sale, and any negotiable instrument executed by you will be returned within TEN BUSINESS DAYS following receipt by the seller of your cancellation notice, and any security interest arising out of the transaction will be canceled.
    3. If you cancel, you must return any goods delivered to you under this contract or sale, or you may, if you wish, comply with the instructions of the seller regarding the return shipment of the goods at the seller's expense and risk.
    4. If you do make the goods available to the seller and the seller does not pick them up within 20 days of the date of your Notice of Cancellation, you may retain or dispose of the goods without any further obligation. If you fail to make the goods available to the seller, or if you agree to return the goods to the seller and fail to do so, then you remain liable for performance of all obligations under the contract.
    5. Cancellation by the homeowner after the above period will result in a $1,000 fee plus any expenses that EVOLUTION POWER LLC may have incurred on behalf of the buyer.
    6. EVOLUTION POWER LLC may cancel this agreement if existing conditions at the site of the work prohibit the work or add additional costs to the work that the homeowner is unwilling to pay for under the change order provisions of this Contract.

    I understand that I can revoke this power of attorney at any time. Any revocation will be effective upon executing a power of attorney revocation form and/or a new power of attorney form and providing copies of the executed copies of foregoing documents to EVOLUTION POWER LLC upon revocation, I will reimburse EVOLUTION POWER LLC for all expenses incurred in connection with any actions it took on my behalf and transferring any documents to me or any superseding attorney-in-fact...
